This Privacy Policy explains how By Design collects, uses, shares, retains, and protects personal information through its website, communications, enrollment process, coaching services, payments, book fulfillment, and learning resources.

2. Scope

This Policy applies when you visit the website, submit a form, join a mailing list or online community, communicate with By Design, apply for or purchase coaching, make a payment, receive a book, or access learning resources. An independent third party's own privacy notice governs its separate website or service.

3. Information We Collect

• Contact and identity information, including name, email address, telephone number, mailing address, and communication preferences.

• Enrollment and transaction information, including the service selected, agreement records, payment status, installment dates, invoices, refunds, and limited payment metadata supplied by a payment processor.

• Coaching and professional-development information you choose to provide, including goals, work history, assessment responses, session notes, Power Blueprint content, action plans, and documents.

• Scheduling and communication information, including appointment details, emails, support questions, chatbot or form messages, and consent records.

• Book-fulfillment and portal information, including shipping preference, account credentials, viewed lessons, downloads, and access history when those features are used.

• Device and website information, which may include IP address, browser and device details, referring page, pages viewed, dates and times, cookie identifiers, and general site activity.

• Marketing preferences and any separate permission to use a testimonial, story, image, or other endorsement.

4. How Information Is Collected

Information may be collected directly from you, automatically through website or portal technologies, from providers that support payments, forms, scheduling, communications, or learning access, and from another person you authorize. By Design does not seek information from your employer without your permission or another lawful basis.

5. How Information Is Used

• Respond to inquiries and administer applications and enrollment.

• Schedule, personalize, and deliver coaching and learning resources.

• Create and update the Power Blueprint and provide agreed email support.

• Process payments and refunds and maintain business, tax, and legal records.

• Mail or deliver Ignite Your Power and provide Core Vault access.

• Operate, secure, troubleshoot, and improve the website and services.

• Send marketing communications when permitted and honor opt-out requests.

• Prevent fraud or misuse, comply with law, and establish or defend legal rights.

6. Coaching Information

Coaching information may be sensitive even when it is not a medical, employment, or financial record. By Design limits access to people and providers that reasonably need the information for the stated purpose. Do not send employer trade secrets, privileged communications, regulated records, or third-party personal information unless you are authorized and the information is necessary. Remove unnecessary identifiers before sharing a document.

7. Payments

Payments may be processed by Stripe or another processor identified at checkout. The processor collects payment credentials and fraud-prevention information under its own privacy terms. By Design receives transaction confirmation and limited payment details and does not intentionally store complete card or bank credentials.

8. Service Providers and Disclosures

By Design may share information with providers that support website hosting, forms, customer relationship management, scheduling, messaging, video meetings, email, payments, accounting, book fulfillment, learning content, cloud storage, analytics, advertising, cybersecurity, or legal services. Depending on how you interact with By Design, these providers may include Automator.ai or GoHighLevel, Stripe, ManyChat, Facebook tools, and other providers displayed when a feature is used.

Information may also be disclosed when required by law or valid legal process, to protect rights or safety where law permits, in connection with a business reorganization subject to appropriate protections, or at your direction. By Design does not use an identifiable client story in marketing without separate permission.

9. Cookies Analytics and Advertising

The website may use necessary cookies for security, session management, preferences, and core operation, and may use analytics or advertising tools to understand traffic and measure marketing.

You can manage cookies through browser settings and any cookie controls provided on the site. Blocking cookies may affect some features.

By Design does not sell personal information for money. Certain analytics or advertising activity may be treated as a sale, sharing, or targeted advertising under some state laws.

If such a law applies, you may request the available opt-out by emailing the privacy contact or using any site control provided for that purpose.

10. Artificial Intelligence and Chatbots

An AI assistant or chatbot may answer initial questions or support administrative tasks. Do not submit confidential coaching details, employer secrets, financial information, or health information through a public chatbot. By Design does not submit identifiable confidential coaching content to an external AI system for substantive analysis without specific disclosure, appropriate safeguards, and any required consent. Human judgment controls material coaching decisions.

11. Session Recording

Coaching sessions are not recorded by default. If recording is proposed, By Design will give advance notice and obtain the consent required for every participant and jurisdiction before recording begins.

12. Retention

By Design retains information only as long as reasonably necessary for the purposes described in this Policy, the coaching relationship, tax and accounting requirements, dispute resolution, security, and other legal obligations. Retention varies by category. Information may remain in secure backups for a limited period after deletion from active systems.

13. Security and Data Incidents

By Design uses reasonable administrative, technical, and organizational safeguards appropriate to the size and nature of the business and the information involved.

No system is completely secure. If a data incident occurs, By Design will investigate and provide notice when required by applicable law.

14. Your Choices and Privacy Requests

You may update contact information, unsubscribe from marketing, decline a testimonial request, or ask about access, correction, deletion, or another privacy right that applies to you. Send requests to [email protected] with your name, state of residence, and the request. Do not send sensitive identity documents through ordinary email. By Design may take reasonable steps to verify a request.

Service messages needed for an active enrollment, payment, scheduling, security, or legal notice may continue while the relationship is active. By Design will not discriminate against a person for exercising an applicable privacy right.

15. Children and International Visitors

The website and coaching services are intended for adults age 18 and older. By Design does not knowingly collect personal information from children under 13. The business is based in the United States. If you access the website from another country, information may be processed in the United States, where privacy laws may differ.

16. Policy Changes and Contact

By Design may update this Policy to reflect changes in law or business practices. The revised policy will show a new update date, and additional notice will be provided when required. A material change will not retroactively authorize a new use of previously collected information when consent or another legal basis is required.
