These Terms govern use of the By Design website and its free public resources. A signed coaching agreement or transaction-specific checkout terms govern any paid program or purchase and control if they conflict with these general website terms.

This website is operated by Belinda Crouse, a sole proprietor doing business as By Design. Success By Design is the coaching brand of Belinda Crouse.

2. Acceptance and Eligibility

By accessing or using the website, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the website. You must be at least 18 years old to purchase a service or submit a coaching application.

3. Educational Information and Coaching Scope

Public website content is general educational and professional-development information. It is not individualized coaching unless provided under a signed coaching agreement. By Design does not provide medical or mental-health care, legal advice, tax advice, financial or investment advice, human-resources representation, recruiting, or employment-placement services. Consult an appropriately licensed professional when needed.

4. No Guarantee of Results

By Design does not guarantee a raise, promotion, bonus, job, business revenue, personal transformation, or other financial or career result. Results depend on each person's circumstances, actions, workplace, decision-makers, market conditions, and other factors outside By Design's control. Testimonials and examples describe individual experiences and are not promises of what another person will achieve.

5. Purchases and Coaching Services

The price, payment schedule, deliverables, dates, cancellation and refund terms, access period, and any renewal terms for a paid service are stated in the checkout terms or signed agreement for that purchase. Those transaction-specific terms control. Powerful & Paid is a fixed-duration coaching engagement. Included Core Vault access does not automatically convert into a paid membership, and any continuation requires a separate affirmative purchase.

6. Accounts and Access

You are responsible for accurate account information, protecting login credentials, and promptly reporting suspected unauthorized use. Access is personal and may not be shared, transferred, resold, or used to provide paid materials to another person. By Design may reasonably suspend access for a security risk, unlawful conduct, material payment default under an applicable agreement, or serious misuse of content, subject to notice and applicable law.

7. Intellectual Property

The website and its original text, videos, graphics, lessons, methods, worksheets, templates, scripts, prompts, downloads, and compilations are owned by By Design or used with permission. Unless a purchase states otherwise, you receive a personal, nonexclusive, nontransferable license for your own professional development. You may not sell, sublicense, publish, distribute, teach from, provide public access to, scrape, or use protected content to train an AI model without written permission, except where law permits otherwise.

8. Messages Submissions and Reviews

You retain ownership of original material you submit. You grant By Design a limited license to use it only as reasonably necessary to respond, provide the requested service, administer the relationship, protect legal rights, and comply with law.

A testimonial or marketing use requires separate permission. You may provide an honest review. By Design does not condition an incentive on a positive review and does not prohibit a lawful negative review.

9. Communications

Service communications may concern enrollment, payment, scheduling, security, access, or policy changes. Marketing email or text messages are sent only as permitted by applicable law and may be stopped through the stated opt-out method. Opting out of marketing does not prevent necessary service communications for an active relationship.

10. Third Party Services and Links

The website may use or link to independent providers for hosting, forms, customer relationship management, scheduling, payments, video meetings, email, messaging, learning content, analytics, social media, or advertising. Current providers may include Automator.ai or GoHighLevel, Stripe, ManyChat, and Facebook tools. Their own terms and privacy practices may apply. A link does not mean By Design controls or guarantees the third party.

11. Website Availability and Security

By Design uses reasonable measures to operate the website and protect information, but no website, transmission method, or online system is error-free or completely secure. Website features may be maintained, updated, replaced, or discontinued. A change affecting a paid service is governed by the applicable purchase agreement and law.

12. Prohibited Use

You may not use the website to violate law, interfere with security or operation, introduce malicious code, gain unauthorized access, impersonate another person, collect personal information without authority, misuse program content, or infringe intellectual property, privacy, publicity, confidentiality, or other rights.

13. Website Disclaimer and Liability

To the fullest extent permitted by law, the public website and free content are provided as available without warranties not expressly stated. By Design is not responsible for loss caused solely by reliance on general public information, an interruption outside its reasonable control, or an independent third-party service. This section does not alter an express promise in a paid agreement or limit any warranty, remedy, or liability that cannot lawfully be excluded.

14. Governing Law and Disputes

These Terms are governed by South Dakota law, without limiting consumer protections that cannot lawfully be waived.

Before filing a claim, you may contact [email protected] to attempt a good-faith resolution. Unless applicable law requires another forum, disputes relating only to use of the public website may be brought in the courts serving Codington County, South Dakota. These Terms do not require arbitration or waive jury or class-action rights.

15. Changes and Contact

By Design may update these Terms prospectively by posting a new revision date and providing any additional notice required by law. A change does not retroactively alter a completed purchase or signed agreement unless the parties lawfully agree.
